Promotion Of 68 Gujarat Judicial Officers Stayed By Supreme Court
The Supreme Court on Friday stayed the promotion of 68 lower judicial officers in Gujarat, including Surat Chief Judicial Magistrate Harish Hasmukhbhai Verma. Surat’s Chief Judicial Magistrate (CJM) Hasmukhbhai Verma had convicted Congress leader Rahul Gandhi in a defamation case.
A Supreme Court bench of Justice MR Shah and Justice CT Ravikumar observed that according to the Gujarat State Judicial Service Rules 2005, the principle of merit-cum-seniority and passing the qualifying examination should be followed by promotion. The rules were amended in 2011.
An order issued by state government illegal: Supreme Court
The list issued by the High Court and the order issued by the state government for the promotion of district judges is illegal and contrary to the judgment of this court, the bench said. Therefore it cannot be sustained.
